Update!! HR 6304 - A Bill to Abolish the 4th Amendment.. IS NOW LAW!!
This is an update of this post.
On 7/8/08, Dubya Bush signed HR 6304 into law, allowing the gov't to spy on Americans,
It also:
1) Allows the telecom companies to kept it secret and protects them from lawsuits and prosecution,
2) Permits the gov't not to keep records of searches, and destroy existing records,
3) Increased the time allowed for warrantless surveillance to continue from 48 hours to 7 days,
4) Prohibits the individual states from investigating, sanctioning of, or requiring disclosure by complicit telecoms or other persons,
5) Removes requirements for detailed descriptions of the nature of information or property targeted by the surveillance,
6) Requires FISA court permission to wiretap Americans who are overseas,
7) Prohibits targeting a foreigner to eavesdrop on an American's calls or e-mails without court approval,
8) Allows eavesdropping in emergencies without court approval, provided the government files required papers within a week,
9) Prohibits the government from invoking war powers or other authorities to supersede surveillance rules in the future
10) Removes requirements for detailed descriptions of the nature of information or property targeted by the surveillance
and pretty much rapes The Fourth Amendment.
This was passed without The Mainstream Media saying a damn thing!
This is what The Fourth Amendment says:
"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."
